How to get Work Permit in Turkey?

Obtaining Work Permit in Istanbul or Turkey is commonly asked questions by foreigners who wish to work in Turkey. Very first thing a foreigner should know is that there are different kinds of “Permit” allowing foreigners to work legally. Also it is not possible to apply for work permit without an employer. If the employer is a legal entity, in other words a company, there must be 5 Turkish citizen working for that company. However this rule is loosened for Syrian refugees. In case the applicant is a Syrian refugees, ministry of labor will not seek all the requirements mentioned in regulation.

Permits is granted for one year. And after one year it can be renewed by the employer. Also there are permits  allowing the concerned one work independently or a permit which is exclusively for company shareholders, by the way such permits are more difficult to get. Should the employer or the employee decide not to continue such work relation the permit should be cancelled by way of making an application to the very same directorate of Ministry of Labour.

Requirements and the documents for each permit types are different. Besides, not only the person having intention to work is required to submit documents but also the employing company or the enterprise to which that person is a shareholder, should match the envisaged criteria under applicable law. Even though the applicant fulfils all the requirements, ministry of labour has ultimate discretion whether or not to grant such permit.

If your application is rejected due to any reason, you have right to file objection to the ministry. If your objection is not accepted then you have 30 days to file a case before the Administration Court against the Ministry in order to revoke reject decision. However in such cases you should prove that not only the requirements are met but also foreigners employment benefits the country or the employing company is in a concrete need of having such personnel and/or director.

Last but not least, we should inform those whose work permit is expired or cancelled: They must have residence permit to continue living in Turkey because; once the work permit is cancelled or expired residence permit is also cancelled or expired without further notification.

Best Regards,
